Introduction

Welcome to Ooliga. These Terms of Service ("Terms") govern your access to and use of our job portal platform, including our website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

1. Acceptance of Terms

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. User Accounts and Registration

2.1 Account Creation

To access certain features of the Platform, you must create an account. You may register as either a job seeker or an employer. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Use a strong password and keep it confidential
  • Notify us immediately of any unauthorized use of your account
  • Not share your account with others
  • Log out from your account at the end of each session

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may also delete your account at any time through your account settings.

3. User Obligations

3.1 Job Seeker Obligations

As a job seeker, you agree to:

  • Provide accurate and truthful information in your profile and applications
  • Keep your resume and profile information up to date
  • Not misrepresent your qualifications, experience, or credentials
  • Respond professionally to employer communications
  • Not use the Platform for any purpose other than seeking employment

3.2 Employer Obligations

As an employer, you agree to:

  • Provide accurate information about your company and job postings
  • Post only legitimate job opportunities
  • Not discriminate based on race, gender, age, religion, or other protected characteristics
  • Comply with all applicable employment laws and regulations
  • Respect candidate privacy and handle their information responsibly
  • Pay all applicable fees for using employer services
  • Not use the Platform to collect candidate information for purposes other than recruitment

4. Acceptable Use Policy

You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Platform. Specifically, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Post false, misleading, or fraudulent content
  • Harass, abuse, or harm other users
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Use automated systems (bots, scrapers) to access the Platform without permission
  • Collect or harvest personal information of other users
  • Post spam, advertisements, or promotional content without authorization
  • Impersonate another person or entity
  • Interfere with the proper functioning of the Platform

5. Job Postings and Applications

5.1 Job Posting Guidelines

Employers must ensure that all job postings are legitimate, accurate, and comply with applicable employment laws. Job postings must not contain discriminatory language or requirements that violate equal opportunity laws.

5.2 Application Process

When you apply for a job through the Platform, your application information will be shared with the employer. We are not responsible for how employers use or handle your application information.

5.3 No Employment Guarantee

Ooliga is a platform that connects job seekers with employers. We do not guarantee employment, interviews, or any specific outcomes from using the Platform. The employment relationship is solely between the job seeker and the employer.

6. Intellectual Property

6.1 Platform Content

The Platform and its original content, features, and functionality are owned by Ooliga and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 User Content

You retain ownership of any content you submit to the Platform (resumes, profiles, job postings, etc.). By submitting content, you grant Ooliga a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and improving the Platform.

6.3 Trademarks

"Ooliga" and our logo are trademarks of Ooliga. You may not use these trademarks without our prior written permission.

7. Payment and Billing

7.1 Employer Fees

Employers must purchase credits to post jobs and access certain premium features. All fees are non-refundable unless otherwise stated or required by law.

7.2 Payment Processing

Payments are processed through third-party payment processors. You agree to provide accurate payment information and authorize us to charge your payment method for all fees incurred.

7.3 Refunds

Unused credits may be refunded within 30 days of purchase, subject to our refund policy. Refund requests must be submitted through our support channels.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OOLIGA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

We do not guarantee the accuracy, completeness, or reliability of any content on the Platform. We are not responsible for:

  • The conduct of users or third parties
  • The accuracy of job postings or user profiles
  • Employment decisions made by employers
  • Disputes between users
  • Any damages resulting from your use of the Platform

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Indemnification

You agree to indemnify, defend, and hold harmless Ooliga and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another party.

11. Dispute Resolution

11.1 Informal Resolution

If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally by contacting our support team.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ooliga operates, without regard to its conflict of law provisions.

11.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.

12. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Platform, constitute the entire agreement between you and Ooliga concerning the Platform and supersede all prior agreements and understandings.
